The final revised FMLA Regs state that the general notice can be posted electronically and the rights and responsibilities notice can be distributed electronically, but it does not say that the eligibility or designation notices (WH-381 and WH-382) can be provided electronically.

Does anyone know if we can provide those notices to employees via email?

I've been taking the "safe" route and using snail mail to employee's homes. Few of our employees have computer access, though, so really it's my only recourse.

I imagine you could use email to send all FMLA notices. It's documentable, fast, easy, and gives that impersonal touch. I don't know the legalities, though. Sorry I can't help answer the question.
