Health Care Reform: one of the items that takes effect right now.....
Breastfeeding at work
Effective immediately, employers with 50 or more employees must provide breastfeeding workers with “reasonable break time†and a private, non-bathroom place to express breast milk during the workday, up until the child's first birthday. Employers are not required to pay for time spent expressing milk.
We do, in fact, have several employees effected by this. We have very nice private restrooms in our offices which we have made available for just this purpose. My question to this group - we can have other space available and still offer the private restroom and let the employee make the choice - are we complying?

A restroom does not comply with the law and it also does not comply with the many state laws regarding this no matter how "nice" you feel it is it's still a bathroom.

As long as you have BOTH, you would be complying. No reason to take away your "nice" bathroom.....because other ladies probably appreciate it too!

rrupert is right again! As someone working in HR and currently expressing for my infant, I like this law! Yes, a separate "non-bathroom" area must be available. If the restrooms have private lobby-type areas available, that may suffice, but the area must be private and not contain a toilet. Best bet is to set aside an empty office and put blinds in the windows to the common areas. Just in case.
