Great catch, howard. But wouldn't this apply only in those jurisdictions in which sexual preference is protected?

You may be correct that retaliation claims can only apply to those in protected classes.

Not exactly true, shoot even HR people can bring and prevail in claims of retaliation and I think we are the least likely to be in a proptected class. ;-(

Seriously, one does not have to be in a protected class to prevail in a claim of retaliation.
