Supervisor following employees

I'm not sure whether or not this belongs in the legal forum, but I've recently heard from a few co-workers about a supervisor that is "following" them when they take their break periods.

The employees go to the company kitchen, only to be followed by the supervisor within a few minutes. The supervisor doesn't speak to the employees or stay for their entire break period, just piddles around for a few minutes then leaves. The employees have different break periods, so the supervisor is going back and forth throughout the day.

This behavior apparently coincides with the supervisor's cracking down on the employees' break periods. Also, the supervisor is not following all of the employees, just a few of them.

The employees are considering writing a letter of complaint to the supervisor, but aren't sure if this is true harassment or just obnoxious behavior.

I appreciate your comments and suggestions.

Speak to the supervisor. If the following-around is indeed an effort to control break irregularities (and I bet that it is) then that's fine, and the employees should then be told that it's fine. If the employees continue to object, tell them there's nothing wrong with a supervisor monitoring employees' behaviour while they're at work, including during break periods.

Just remembered this is the legal forum.

In addition, there's nothing illegal about a supervisor following his/her employees to a break room. If the employees don't like this, that's too bad, they have no legal recourse.

The key to this is when you say the supervisor only follows certain employees. If these are employees with a history of excessive breaks, then the supervisor is doing his job, albeit in perhaps not the most effective manner. If these employees are in a protected class and are being watched as a result, then they may have a claim for harassment, as excessive monitoring can be considered such.
