in general terms you are correct. If any part of any one day is worked then it is possible the "ready and able" clause could be in effect.

My favorite example is a hurricane or blizzard. Exempt EE shows up on Monday A.M. Told to go home for the week because the business is closed due to one of these events. Person has used all accrued PTO and has none available. The week is paid.

And where I work, exempt employees who work any part of a PTO day may not be required to use PTO at all (we only allow PTO in 8 hour increments for our exempt employees). And then there are those who work all of a day off and still use PTO.

I believe you could also still charge the person's PTO bank and let it go into the negative and then when the person accrues more PTO it will work itself out.

Another thing to consider is how your leave policy is written. For instance, sick leave can be taken in increments as small as 15 minutes. However, vacation must be taken in 4 or 8 hour blocks. So whether or not we dock pay, after a period of time worked that is less than 4 hours, would dictate whether we would require leave to be taken against the bank or whether we would just pay for the day worked in whole without charging to the leave bank.
