I'm in California, where ER's are required to allow up to 2 hours paid time off so EE's can vote. But are we *required* to allow the paid time off when we are the second (part-time) job for this emplo

I'm in California, where ER's are required to allow up to 2 hours paid time off so EE's can vote. But are we *required* to allow the paid time off when we are the second (part-time) job for this employee?
- He works two jobs
- He works for us part-time
- He was only scheduled for five hours on voting day
Any opinions or experiences?

Do you think the code could be read to indicate that we are required to provide the time off ONLY if the employee's schedule does not provide the time required? It just doesn't follow that the employee can't find time in the 13 hours that the polls are open, when his shift is only 5 hours. It's not like he has a four-hour commute.
