Are you able to terminate a new employee that was sleeping during New Hire Orientation. She was spoken to on the 1st day of orientation and then sent home. She came to the 2nd day and was sleeping again. The manager wants to terminate due to performance.

We experienced a similar event...employee fell asleep the 1st day during initial training. She said she was so relieved to get a job that her system just 'shut down'. She was paid for the time she was with us and terminated. Upon exiting the building, she did ask if she could apply again.
