We have an hourly employee (housekeeper) that has a tendency of either not punching in when she comes in or leaves or forgets to hand him punched timesheet in at the end of each week. 1. Is there anything legally written for hourly employees that they must hand in their timesheets weekly? and 2. If they don't hand them in, can we legally hold up their paycheck when payroll is being done?

You can't hold the paycheck if you have reasonable knowledge of the hours they worked, but you can use your standard disciplinary Proccedure to deal with it.

It's the responsibility of the employer to collect time card information. If your system isn't working, then you need to figure out something else or, as the above poster noted, apply disciplinary measures.

yes, I believe the dept. has reasonable knowledge of hours worked....so I guess they have to give the employee their paycheck...thanks for reponding.

As far as disciplinary actions, any suggestions or thoughts?

Give her a memo that states she will be fired if she forgets again. Then, if she forgets again, fire her.
