Hi All,
I am working in a Software MNC based in USA as Software Engineer. I am currently based in Bangalore,India. I am going through this difficult situation.Please suggest me how to proceed.

I joined this company 2 years back in June month and hence according to our comapny policy I am eligilble for CTC revision in July month every year and I got the revised CTC amount as salary in July 2010 month end. But the company usually sends the breakup of new CTC a week or later, ie August first week. The problem here I am facing currently is explained in the following lines. I got a new offer on a good company during August 2010 second week. After much waiting for the breakup of new CTC I decided to go ahead with resignation since the new company cant wait for long.

But I took attestation of last six months payslips from my financial officer as a proof of my July month salary according to revised CTC.But now when I went to financial offer and he is saying they may revert my CTC to old one. Also he is saying me to return the attested documents. How can I proceed with this ? Did comapny have right to revert my CTC once it is hiked? I agree that I don't have official breakup mail of my revised CTC. But I have payslip with his signature and Tax reports for 201-2011 which also shows my new CTC. Please let me know .

If you are an Indian citizen living and working in India, then Indian employment law applies to your situation. Unfortunately, these forums focus on US employment law, and as a result, probably won't be of much use to you.

I'm sorry, but everything that the company is doing/not doing may be completely legal according to Indian law - in which case there's nothing you can do. Or it may be completely illegal under Indian law, in which case you may have some legal recourse. However, not only do we not know what that recourse might be or how you might go about accessing it, we don't even know if you have any recourse in the first place.

In other words anything we might tell you will probably be wrong.

Ok. In US what will be the solution similar to my problem. Also Mine is a USA based company.So policy of Company stands above the policy of land.

As I told you before, US law does not apply in your situation. Period.

Given that US law is extremely different from Indian law, US law answers would be worse than useless to you. I already advised you of this too.

If you really want to help yourself, you should stop wasting your time on these forums and seek the advice of people who have some knowledge of Indian employment laws. (And you won't find those people here.)

Policy of a MNC never stands above the "policy of the land" as each company must operate under the laws of its host country.

Can you please advise me how to proceed since I don't have official CTC Breakup document from management but only attested payslips? Thanks in advance.

Yes...I would suggest you contact competent legal authority in India. As has been shared with you here already, this is predominately a US network and what ever advice you obtain here must always be treated with some skepticism (even if we all do think we are pretty smart)

Here in the US there are a couple of remedies. If its a violation of wage and hour law, there are federal and state agencies which will investigate.

However, in your case, it appears that you were promised a certain amount of pay and the employer reneged. That would most likely be a civil court action and involve engaging an attorney.
