We are a non-profit mission organization and we currently have 2 positions that we need to fill by the end of this year. We have 2 internal people qualified for both of these positions that we'd like

We are a non-profit mission organization and we currently have 2 positions that we need to fill by the end of this year. We have 2 internal people qualified for both of these positions that we'd like to extend these positions to and we know they would accept them. My question is, for legal purposes, do we still need to run an outside ad for these positions or can we just hire these internal people without doing that?

Unless these external people are outside the US and the INS needs you to run an ad to ensure there aren't any qualified Americans wanting the job, then no, you legally aren't required to run an ad. You may legally go ahead and hire anyone you wish, as long as whoever you hire is legally able to work in the US.

If you are subject to an AAP because you are doing work for the US Government, you may have a requirement to post all open positions at certain outside agencies.
