Not to disparage the advice of our resident legal experts, but wouldn't it be best to consult with one's local wage and hour division?

For mostly guaranteed advice Deltac that would be the best course of action. Some folks, for what ever reason, are not comfortable doing that.

I can recall a situation of my own, once upon a time, where a rather heated discussion over what was or was not compliant under the FLSA occurred. I simply called Wage & Hour, got the answer (it was the same as mine but I digress) and reported it back to the executive group. When asked the source, I told them. I thought the CEO and COO were going to need CPR.

What can I say. They were upset because of SOX and the fact that I may have brought unwarranted attention to the company. Of course the fact that myself andf the two Corporate Attorneys had also been telling them the same thing was lost on them. (These are the same people that demanded I get an exemption from both the FMLA and the ADA because it would be too hard to manage)

Thank you all for your input....What we ended up doing was paying him for the hour -his 25 minutes worth of work plus his 5/6 minute commute each way - so we just paid him the hour. He was really appreciative bc he wasn't expecting it - especially since he said he was only here a few minute.

you and me both deltac. I simply don't get that stuff and I've been doing this for a long time. I truly dislike playing compliance cop but these so called leaders who think you can break the rules, pay a fine and do it again, truly sicken me.

The mentality is that they think our role is to help them bend the rules and work the system, just like they expect their accountants to find tax loopholes.

I actually had one CEO who was actually eager to comply with pay rules. Seriously. Even willingly went through an exercise to correct overtime pay for 2 years for 50+ hourly workers because of a misbegotten bonus plan put in place before I got there.

A year later I found out that he and the chairman were lying on quarterly and annual reports and he was eager to comply because he didn't want any complaints to any federal agency that might put inspectors onsite! A week after I left, the SEC indicted both of them.
