So, I have an employee who has been cleared for work after being out on LTD. There is no positions available to her. There was a position that was available but management fought back to say training is not feasible because they are busy (I thought thats what made you a manager) the contact is silent to returning to work when the company doesnt have a job. The contact speaks to the employee returning to a job of the same class and/or family abnd the company can separate after 24 months of continous LTD. My director has only answer to me is "What does the contract say?" Which leads me to she doesn't know what to do since she is the one that told management they don't need to take her. In my past work experience, the company pays straight time and benefits until a position is available.

Any one with thoughts?

If the contract is silent you don't have to do or pay anything. However, you can anticipate a grievance and the gyrations of going through that.
