I see a thread relating to hiring as employees physicians who were independent contractors. My situation is different, though probably not uncommon. I am just not comfortable with the info I am finding.
We have retired teachers (not retired from our org) who we want to contract as consultants to work with some of our teachers as mentors/coaches. We will provide them with information about the curriculum we use and would like for them to be in the classrooms observing throughout the morning (when most of the critical stuff happens), and to spend some time with the teachers after the children leave providing feedback, suggestions, etc. Initially, we are thinking of paying a rate per hour for these consulting services. That makes me nervous. They only have so much budgeted for this service, so it starts to look like they are being paid for a set number of hours per week. Can a consultant be paid per hour for their services and not be an employee?

Oh, and they want observation notes. That sounds like reporting to me.

There's nothing wrong with paying consultants by the hour. However, you would be very wise to have them each set up their own LLC, get an employer ID number, and invoice you for their services OR have them register with a local temp firm from which you will hire them. Do not put them on your payroll to pay them.
I can't see how providing "reports" would be an issue. A lot of consultants conduct research and provide findings such as these.

Agree with Nork. It would be better if they were a consulting company and you were paying the company rather than an individual. That way they could also get work from other schools/districts and yours would not be their only client.
Who decides how often they are there (within the budget constraints)? Say the budget is for 6 visits plus the report. Who will be setting the schedule, deciding when they visit? Or will you just set a deadline and they can visit as often as they like?
I think you would be better off letting them decide when and how often they will come within the budget. Yes, you can set a maximum amount of hours and yes, you could pay by hour..but I would be more tempted to pay by project that contains a min/max # of hours plus the report.
You say you are giving them your curriculum but are you telling them specifically how they have to mentor? I would not. That should be the expertise you are paying them for....
I usually argue against ICs...because I feel the line is crossed too much. But if you can set this up correctly, I think it would work. The question is will your school district pay for ICs?
