back injury?

We have an employee who injured their back at another place of employment.She did not report it to workers comp there.She announced to other employees here that she has a fractured vertebre and we have not recieved any doctors notes stating this.What are my next steps as an employer? What if she has a broken vertebre.

I would require a (100%) fit for duty certification since she mentioned it to others. I would not allow her to work until I received such. You might call your WC broker too and get their input. You surely don't want to become party to any WC claim!

Then I would look into any protected timeoff that she may have available -- FMLA, state-related leave laws, etc.

Totally agree with rrupert. Now that you know she's got a back injury, allowing her to work at your organization can totally set you up to be on the short end of the liability stick. Absolutely send her home until she produces a fit to work statement from the doctor.

Depending on the questions on your application that I assume this person signed during hte employment process, she may not have been truthful during the employment process and could be terminated for this serious infraction.

I also have some concern regarding the robustness of your preemployment physical.
