While your company might feel justified in laying off this worker, the fact that the female worker is preganant is a potential problem. Is her level of performance due to the pregnancy? Does she have a medical condition (from the pregnancy) that is the issue? What was her performance like before the pregnancy? Has she been given written warnings regarding her work performance. I am with others who encourage your supervisior to consult an attorney before making any decisions that will cause potential grief for your company if an adverse action is taken.

Discussions such as these are the reason(s) there will always be a labor movement and for a need for FMLA...

Not at all the reason why there will always be labor unions. But it is certainly a reason why there will always be plaintiff attorneys.
