We are nationwide and would like to begin pre-employment drug testing...do all states allow this? Also, do all states allow credit history checks?

We are nationwide and would like to begin pre-employment drug testing...do all states allow this? Also, do all states allow credit history checks?

Hi:
State laws regarding drug testing vary, and hence you should check to ensure your company is compliance with any specific mandates. As for credit checks, currently Hawaii, Maryland, Washington, Oregon and Illinois have statutory restrictions in place--this is a growing legislative phenomena and I would expect a significant number of additional states to enact similar legislation during this year's sessions.
