Currently we have a Jury Duty policy that entitles the emps paid time off, not using their personal time off. I now have an emp that was subponaed to witness duty by the Superior Court. Should this be

Witness Duty - paid or unpaid?

Currently we have a Jury Duty policy that entitles the emps paid time off, not using their personal time off. I now have an emp that was subponaed to witness duty by the Superior Court. Should this be counted just like jury duty and the emp would get paid?

While you may not be required to pay for this time off I would certainly pay them the same as jury duty since they have no choice but to go to court.

I am not sure what witness duty is. Were they called to testify as a witness? If so, was it through any actions of theirs? I was a witness in a robbery trial and was called to potentially testify twice. Luckily once it was postponed and the second time they plea bargained. In a case like that, I would still pay wages.

However if they were called to due to something under their control (i.e. say not paying back child support etc), I would require they use personal time or PTO.

While I do wish our company could pay for time off for jury duty, in most cases we do not.

Some states do require payment for jury duty up to a certain limit. Might be a good idea to check your state laws for anything similar including pay for subpoenaed court duties
