If you terminate and issue a severance agreement to an individual employee who is not part of a mass layoff, does the over 40 law still apply? (that they are given 45 instead of 21 to consider the offer?.

Yes, it is my understanding that ADEA still applies even in a single termination. However,it's been a while since I have used or researched it. 

But severance agreements are not a DIY project so I would pass it by corporate/employment counsel to be on the safe side.
