HR Mediator or Lawyer to Settle Employee Issues?

I am a 20 year veteran of Human Resources (Generalist) and have also become a Qualified Neutral (Mediator/Arbitrator) because my strength is in dispute resolution. If you as an HR professional had an employee dispute that could escalate into a legal dispute (funny how that happens), who would you feel more comfortable turning to: An Employment Lawyer or an HR Mediator?

I'm curious if HR professionals have faith in their own, or if they still feel that only a lawyer can get you through the rough times.

My decision would be based more on my perception of the employee's motivation to actually settle the dispute versus clean up in a lawsuit. There have been times when it was obvious to me that legal protection during the "mediation" process was an utmost concern. Here I trust HR to make the call through an investigative process first.
