Cleaning out personnel files

I am in the process of updating, making sense of, and cleaning out our personnel files. (Might I add that I started managing HR when the former HR Manager retired.) As I am attempting to make our files compliant with federal and state laws, I have a question about purging items that I do not believe should be kept in the personnel files. For instance, for many years, it has been acceptable for supervisors to write fairly scathing notes about their employees and have them submitted in the employees' personnel files. These notes are of a personal nature and no warnings or discipline was given to the employees. I am sure that the employees are not aware of these notes, even though they may review their files, not many do. I was attempting to get rid of these notes (most from a General Manager who hasn't worked here in 3 years), but the President is sure that ridding of these notes is illegal. I never heard of such a thing, but thought that I should check it out first. Anybody know what to do? Thanks!

I highly recommend a seminar called "Personnel/HR record compliance workshop" by council on education in management. Their number is 704-522-1236. They may have one in your area. My reference material indicates that records pertaining to transfers, demotions, promotions, layoffs and compensation decisions must be retained for 1 year. It also sounds like your managers could use some training in effectively and legally disciplining employees.
