Terminating an Employee while on disability leave

I have an employee who was hurt on the job after one day of employment and has been out on disability for 9 months. He has just informed me that he will be back to work on November 4, 2002, but I do not want him back. Can I terminate him without any legal ramifications?

Not without potential liability for workers' compensation retaliation or under the ADA. Consult a lawyer regarding all the specifics of this case before deciding not to bring the employee back.
