does anyone know where i can find a sample policy for personal cell phone use on the job? having a real problem with employees taking calls and text messaging while at work!

does anyone know where i can find a sample policy for personal cell phone use on the job? having a real problem with employees taking calls and text messaging while at work!

I don't see an issue with text messages. So long as employees aren't sitting in after call wrap up, or texting while on a call, no harm no foul.

We ask our employees to keep their phone off during work hours -- unless they have an emergency situation. They can return their messages during breaks and lunch. There is nothing worse when working in the public than to have the employee stop and take a personal phone call. Very poor customer service.

to Kramtronix: Seriously, you don't find that a customer service issue? your workers must be in a job where they have a lot of downtime and no face to face contact with customers.

We invoke a leaveum in your car rule with our retail associates. Have actually been told by one 20-something that we were denying her constitutional right to communicate. Maybe thats covered under Life, Liberty and the Pursuit of Happiness.

Since most of our employees are hourly we take a rather old-fashion view that when youre on-the-clock were paying you so we get to make the rules.

You don't need a policy, simply tell them no. Managers have the authority to say no regarding things like this and they shouldn't be required to have a written policy. being consistent would be important but a written policy remains unnecessary.

I happen to agree that a policy is not necessary; however, our owners required that our company have one. This is what exists in our handbook:

It is understood and accepted that occasional phone calls will need to be made or taken with regard to personal business. However, there shall be no routine phone calls, and perceived abuse of this policy, at the discretion of the Company, may be met with disciplinary actions.

Seems to me you already have a policy. Simply use that language and be done with it. It doesn't have top be any fancier than that and in this instance too much language could be problematic.

Right on.

Tell your employee that she can check most of her constitutional rights at the door when she comes to work. I know you were becing facetious and not to split too many hairs, but "life, liberty and the Pursuit of Happiness" isn't in the Constitution - its' the Declaration of Independence.
