If you have a special signed release from your applicant, often added to the end of the initial job application, the applicant has the legal notice of your conducting a background check. However, be sure to have the 3rd party that actually does the background check provides you with their policy of keeping the personal information stored.

Is there an obligation to check these lists in the pre-employment background checks?
e.g.:
Denied Restricted Parties Lists, OFAC lists check, Global Homeland Security Search, "Specially Designated Nationals" or "SDNs."

as it relates to employment verifications, has anyone used the 360 degree reference check model through SkillSurvey or Checkster? This 'newer' approach is all web based and reference requests are sent by the candidate to the respondent and are suppose to produce a higher response and better quality results. Has anyone heard anything about this new way of getting employment references?

It would be in no violation of privacy as long as you check on information that are supposed to be shared publicly. It utterly becomes a violation if you hire someone to go deeper into the account to find the nitty gritty about this person. It is but normal to do background check on a person as papers that are submitted are usually not enough to prove someone's worth.

Here are some tips on how to perform a background check for pre-employment screening: 1) Have the applicant sign a disclosure that grants permission to perform a background check before you do anything else. 2) Consider outsourcing a background checking company to perform pre-employment screening services. Not only can this save your company time and expense, but it can also reduce your liability risk. 3) Respect privacy and discrimination laws. You may not request medical records of an applicant or refuse to hire based on a disability. Likewise, while bankruptcies are a matter of public record, you may not use this information to form a hiring decision. 4) Confirm academic credentials. Nearly 40 percent of resumes contain enhancements, including claims of educational pursuits. 

5) Check the related laws about requesting and using information regarding criminal history.
