What is your company's practice for background checks and drug screening for rehires? Do you have a period of time such as 30 days from termination to rehire in which you do not require the employee to undergo otherwise required background check and drug screening?

I do BGCs on rehires. Have only done them on existing ees if promoted to a higher (supervisory) position more than a year from last BGC. It is surprising what pops up on those 2nd checks sometimes. |

Hi:
A prudent employer would conduct such checks on all applicants regardless of whether they previously worked for the company to avoid any legitimate claims of negligent hiring. I trust this is helpful. Dave Arnold, Ph.D., J.D. |

We have always re-checked their credit, added employment history since they last worked with us, added education if applicable, MVR, and criminal. If things did not change, we did not spend the time or money to re-check, we simply referred to our records. Another note: we always checked out personnel records to see if they were eligible for re-hire (aka they weren't previously fired) AND internal candidates that were applying for jobs that were considered a "driving position" had their MVR checked as well.

We do background and drug tests on all new hires and re-hires. Things can change in even a short period of time and this way we are consistent with the checks; no special exceptions. It is also more prudent for a variety of legal reasons. |
