If you can show that you are posting the positions at diversity web sites and state job agencies then you will be able to demonstrate a good faith effort in trying to attract minority talent.
If after you attract the talent they do not have the qualifications to pass industry wide testing standards that is a different issue and one that you have little control over.
One approach that I have utilized in the past was to pay bonuses to external recruiters that can source qualified minorities.
