Am aware of no obligation to conduct background checks at all absent a statutory requirement to do so (eg government security clearances, DoT requirements, etc). Unless other wise required, a prudent employer does conduct criminal background checks to avoid potential problems in the workplace and even negligent hiring lawsuits.
