Lost potential job due to recruiter/company politics

I've been in the interview process for a couple months with a company. Everything went well, multiple phone interviews and an extensive in-person. I was verbally told they wanted to hire me, and asked for a salary requirement. After that, I didn't hear anything for a couple weeks even after following up.

It turns out the company and the recruitment agency have severed ties and have unresolvable issues. Because I'm tied as a referral to this company, they won't be completing an offer.

Do I have any recourse? I'm extremely upset. If I made a list of the companies I would most like to work for, this would be in the top 2. In the world. I think it's absurd that because I happened to apply through a posting on a certain site, I'm now blacklisted, at least until some unknown time when the referral is void.

I'm trying to work this out with the recruiter, but I don't know how to go about it. This is one referral for them. It's my career.

Any advice?

I'm afraid that there's very little you can do about this situation.  You are, as you state, "tied as a referral" from this agency and the agency would be owed what could be a substantial placement fee (as much as 33% of your first year's compensation) if the company were to hire you.  And the agency could claim a fee should you be hired within up to 12 months of the referral, depending on whatever agreement there may be between the agency and the company.

I think that the only thing you can do is write a very nice letter to the company stating that you really appreciate their consideration, you would very much like to work for the company and, at such time as it might be possible to hire you, you would appreciate being kept in mind.

I would also recommend that you vet placement agencies very carefully in the future.  In my 30 years of corporate staffing experience, I've found that only about 20% (and I'm being generous here) are really any good, and I'm excluding most of the large national recruiting firms from the "good" category. Bottom line is that the more ethical the agency, the less chance you'll have of encountering a similar situation in the future.

Do you think there's a possibility of my referral being voided by the recruiter's agency? I understand that's the antithesis of their business and sets a bad precedent, but I think this case is extreme. The company has said they won't hire me because of the contractual obligations. They're not losing anything by releasing me.

If I were in their situation, it would be a no-brainer. I think they risk their reputation as an agency, and definitely lose my business and anyone I have any sway over if they hold their ground. If they release me, the tables turn and I'd be happy to recommend them to anyone. So it costs them nothing to turn negative reputation into positive reputation... And referrals from me to several great developers, down the line.

not to mention fixing the damage their legal/contractual issues are doing to my career

I'm super sad over this. I've considered talking to a lawyer, even knowing it would probably be in vain. It feels so unjust to do everything I needed to do, and be screwed due to something completely out of my hands :(

It would be the rare agency indeed that would agree to forego a placement fee - there's thousands of dollars at stake for them and it's still not a great employment market.  And reputation is often a very secondary consideration for them.

It is very very hard to overcome agreements between a placement agency and the company.  They are both trying to protect their businesses and I hate to say this, but you are just a small fish in (or really outside) their two ponds.

I would doubt the placement agency would be willing to set the precedent of releasing you. 

Unfortunately you have been tarnished by their bad actions.  I agree with writing directly to the company and stating your interest whenever that agreement goes null...
