Hello,
I have been reading alot about whistleblowers so much that I just skip over the articles. So in return I have some questions about this.
1) Is this becoming a law?
2) What is covered under it if it is a law?
3) What states have adopted this?
4) I'm not sure if this is right so please let me know...If an employee speaks up about something that is wrong in a company the employer cannot retailiate? What if the employee quits then later goes and has a complaint about the employer that is doing something wrong?
Any help on this matter would be greatly appreciated.
I am looking for this knowledge on a personal and professional level.
Thanks in advance to whom ever can help me out.

A number of states have "whistleblower statutes," but I can't list them all offhand. I know Florida has one.
Usually, these statute will prevent a company from retaliating against an employee who has reported the company's legal violations (not just for speaking up about things they disagree with), but the specifics are a matter of state law.

Being an RN from Massachusetts, I beleive a whistleblowing bill passed in the late nineties brought on by employees in the healthcare profession as nurses and resp. therapist noted breahces on patient care and billing. The NLRB was involved in three cases and from here the bill was implicated to encourage other employees to come foward. There comments and participation with such information was now protected under the whistleblowing law. Also medicare compliance laws also were strenghtened in Massachusetts after this event. You can get more inforamtion by looking up Commonwealth of Massachusetts State House, and looking up "whistleblwoing". If I come across any articles I will foward them to you. Also you can probably tap into Department of Labor, since may states are developing and implimenting these laws.

Retaliation for reporting or questioning a violation of public policy is strictly illegal in all 50 states and the District of Columbia.
If the retaliation includes the following: Harassment, demotion, or termination it is actionable.
How could you possibly ask such a question?
Now the Sarbane Oxley laws require strict adherence to the documentation of company activities which protect the retaliatory and criminal conduct of public policy violators. Such criminal conduct is the destruction of evidence in dispute of an allegation of wrong doing.

It was stated the Sarbane Oxley laws require strict adherence to the documentation of company activities which protect the retaliatory and criminal conduct of public policy violators.
Can someone explain in greater detail what is considered criminal? How would a general worker know?

Daily Q&A
How Do We Keep Our Best During Upheaval?
Things are getting scary for us. We recently had to downsize, and since then have lost some of our best people to other jobs. Aside from boosting their pay (which isn't feasible now), what practical steps can we take to keep them from quitting on us?
