That would be a company policy. Check your job posting policy to see how it reads. If it dosen't address it then I'd say it's allowed.

The policy doesnt address the requirements. However, it does have a LOA- Reinstatement
Policy, which would suggest employees on FMLA are considered inactive?

As hrpob stated, it's a company policy decision. And yes, I would say most companies consider someone on FMLA as "inactive". That said, if someone who is on FMLA status applies internally for a posted position, it would be difficult to consider them for that position -- if the position is open, then obviously they need someone to fill it. If the applicant is on FMLA then they are not available to fill the position. Does that make sense?
