We have an employee who was injured on the job and has been off work since October, 2006. She has been given permission to return to work with very restricted work conditions. She's a nurse and cannot work longer than 8 hours per day (we have 12 hour shifts), cannot lift more than 10 lbs, etc. We have a return to work policy that says we can place them in other areas, but we have no place for her at this time. Can we refuse to place her in her same position and/or another position?

Provided that she can perform the work, most states require return to work in the same or similar position.

I suggest that you consult with your WC carrier. After all, this is the type of question that you're paying them to answer for you.
