I need some information re: how FLSA relates to public employees. Specifically: an exempt public employee, with a 35 hour work week, 7 hour work-day takes off for a workday (7 hours), he/she has NO benefit days left, Can this exempt employee be docked for taking off a full work day? What about LESS than a full workday, can he/she be docked? Can you recommend FLSA resource material or web sites for PUBLIC employees? Thanks.

When a public employee takes a full day off, if the agency's or government's regulations permit it, that emnploiyee may be docked for the day (or use available accrued time to cover the absence) without loss of FLSA-exempt status. Docking for less than a full day's absence would be in violation of the public employee's exempt status. You can find the DOL regs on FLSA at it's website under FLSA or in the website for the US Codes. There are provisons that address employment in the public sector that make it a little different in some FLSA areas from employment in the private sector.
