Need for clarification exempt employee leave

It has been my understanding that in the state of Maryland, if a salaried employee misses a full day of work and has no vacation and/or sick time available then an employer can dock that employee for

Need for clarification exempt employee leave

It has been my understanding that in the state of Maryland, if a salaried employee misses a full day of work and has no vacation and/or sick time available then an employer can dock that employee for the full day. However, if the employee comes in late, the employer maynot dock that employee. Please confirm this information or provide corrected information. Thank you kindly.

As noted before, the rules for exempt employees depend on the given facts, the current "state of the law" under the Federal wage and hour statute (the Fair Labor Standards Act), and Maryland state law. Under the Federal Fair Labor Standards Act, an employer with a bona fide policy providing for paid sick leave need not compensate an exempt employee for time lost due to illness when the employee uses up the leave extended or has not become eligible for it. STATE wage and hour law could be very different.

I suggest you contact your favorite labor and employment attorney or call the Maryland Department of Labor for more information.
