If a company has a disability plan that pays 100% of an employees wages when they are out sick (after all personal and vacation time used),are they required to pay the same benefits for an employee with a substance abuse problem that is out of work and in an inpatient rehab program?

I'm a little unsure of your definition of "an employee who is out of work and in a rehabilitation program". Is this a former employee; eg one who has been terminated or voluntarily terminated? Or is this a current employee who has been admitted into a rehab program?

If the former, there would be no responsibility on the part of the employer to provide disability pay. If the latter, you should check your disability Summary Plan Description to see if the employee's disability is covered. Or if this is an employer policy with no SPD, then you should review the situation with your employment attorney.

The prior response is on the mark. The first issue is whether the employee is covered at all under the Plan; the second is what coverage the Plan provides. Look at the Plan documents and confer with legal counsel if you have questions.
