We may have a situation where an employee provided us with falsified immigration documents & a false social security card. He is a great employee and has been with us for some time. Two questions: Do we have any other recourse but to terminate him? Do we legally have to notify the immigration bureau of this issue or is terminating him end our liability exposure?

You can give the employee three days to provide GENUINE documents that satisfy the Form I-9 requirements. If he fails to comply, you should no longer employ him. You then have no further legal obligation.

If the person cannot provide genuine documentation within 3 days and we have to terminate them, what is our liability if we get a call from a potential new employer asking about their work performance? Our company policy is to give out date of hire and date of term. But if we know they are providing false documentation (SS# and/or green card), do we have to inform the company of this?
